Recognised Residents Association

One of the first steps Quay Management Services would encourage any Residents or Leaseholders to do when looking to gain a greater voice and collective approach to the management of their development, would be to form a Residents Association (RA). There are two types of Resident Associations to be aware of, Unrecognised and Recognised. A Recognised RA has a legal right to:

  • Request accounts and receipts relating to the service charge.
  • Recommend contractors to perform works.
  • Have the freeholder consult them on appointing a new Managing Agent.
  • Appoint a surveyor to advise on any matter relating to the service charges.

For a Residents Association to qualify to be Recognised, it must have:

  • A Fair and Democratic Constitution
  • At least 60% of Leaseholders being members of it.
  • Recognised and elected officers.

Unrecognised Residents Association

An Unrecognised Resident Association does not have the same legal rights as a Recognised Residents Association. However, should any Residents want to form a Resident’s Association that doesn’t meet the requirements to be Recognised, QMS shall still afford them the same rights.
